The Difference between Claims Made or Claims Occurrence

Claims Made policies only respond to patient complaints and claims that are first notified during the period of insurance. Usually, once the policy ends, coverage ends.

Claims Occurrence policies respond to patient complaints & claims that arise following treatment or advice given during the period of insurance, regardless of how far into the future that might be. So even if the policy is no longer in force cover will be in place.

The terms of the contract will set out conditions in relation to the maximum amount of cover provided and will detail situations that will not be covered by the contract, unlike discretionary policies where there is no guarantee that a claim will be accepted.

Dental nurses must have indemnity to practise and will be asked to declare they have appropriate arrangements in place when they join the GDC register or renew their registration.

In most situations, medical malpractice insurance ends when you exit the medical profession. This coverage is only applicable to claims-made policies. You have no requirement for run-off cover with claims occurrence policies.
