What Is Vicarious Liability?

- A limited company can be named as the provider of care, rather than the individual clinician
- Claims can be directed at the entity or practice, not just the treating dentist

Who Is at Risk?
You need vicarious liability insurance at the practice or entity level if:

- A patient suffers nerve damage during a procedure carried out by an associate and pursues a claim against the practice as well as the individual clinician
- A hygienist causes soft tissue injury during a routine scale and polish, and the patient names the practice as co-defendant
- A dental nurse provides incorrect aftercare advice that leads to a complication, and the claim is brought against the practice on the basis that the nurse was acting on its behalf
- A foundation dentist under your supervision carries out treatment that results in a complaint, and your role as supervisor is scrutinised
In each of these scenarios, the individual clinician may hold their own personal dental indemnity. However, that does not protect your practice.
Why Dental Indemnity Alone Is Not Enough
This is the most common misconception among practice owners. Each member of your clinical team is required by the GDC to hold their own dental indemnity insurance, and many owners assume this covers the practice too. It does not.
Personal dental indemnity policies protect the individual. It is not designed to respond to claims brought against the practice entity or you as a business owner. Without a separate vicarious liability policy in place at the practice level, you could face:
